1. Acceptance of Terms
By downloading, installing or using the Gigbook mobile app ("the App"), you agree to be bound by these Terms and Conditions. If you do not accept these terms in full, you must not use the App.
2. Description of the Service
Gigbook is a free, offline-first mobile app designed for musicians. It allows you to:
- Manage your band's song catalog (title, key, BPM, duration)
- Build and organize setlists for live performances
- Use Go Live mode to run shows in real time with a runtime ribbon
- Manage multiple bands from a single device
All app data is stored exclusively on your device. No account creation or internet connection is required to use Gigbook.
3. License to Use
Juan Cano grants you a personal, non-exclusive, non-transferable and revocable license to install and use Gigbook on devices you own or control, in accordance with these Terms.
You may not:
- Copy, modify or distribute the App or any part of it
- Reverse engineer, decompile or disassemble the App
- Sublicense, sell, rent or transfer the App to third parties
- Remove or alter copyright notices, trademarks or attributions
- Use the App to build a competing product or service
4. Acceptable Use
You agree to use Gigbook only in ways that:
- Comply with all applicable laws and regulations
- Do not interfere with the App's operation or third-party devices
- Do not attempt to access unauthorized systems or data
- Do not involve illegal, fraudulent or harmful activities
5. Data and Local Storage
Gigbook stores all your data (bands, songs, setlists) exclusively on your device. Juan Cano has no access to that information. You are solely responsible for backing up your data. Uninstalling the App will permanently delete all stored information.
6. Third-Party Services
Gigbook uses the following third-party services:
- Firebase Analytics (Google LLC): anonymous usage analytics to improve the App
- Firebase Crashlytics (Google LLC): automatic crash reporting to ensure stability
Use of these services is subject to Google's Terms of Service and our Privacy Policy.
7. Intellectual Property
All intellectual property rights in Gigbook — including its source code, design, logos, name and brand — are the exclusive property of Juan Cano. These Terms do not grant you any rights over Gigbook's intellectual property, except for the limited license of use described in Section 3.
8. Disclaimer of Warranties
Gigbook is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the App will be uninterrupted, error-free or completely secure.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Juan Cano shall not be liable for:
- Loss of data stored on the device
- Losses or damages arising from the use or inability to use the App
- Indirect, incidental, special or consequential damages
- Service interruptions caused by factors outside the developer's control
10. Age Requirement
Gigbook is not directed at children under the age of 13. By using the App, you represent that you are at least 13 years old. If you are between 13 and 18 years old, you represent that you have parental or guardian authorization.
11. Notice for iOS Users (Apple App Store)
If you downloaded Gigbook through the Apple App Store, you acknowledge that:
- These Terms constitute an agreement between you and Juan Cano, not between you and Apple Inc. Apple is not a party to these Terms.
- Apple has no obligation whatsoever to provide any maintenance or support services for Gigbook.
- Apple is not responsible for any claims relating to Gigbook, including product liability claims, legal compliance claims or third-party intellectual property infringement claims.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you as a third-party beneficiary.
- By using Gigbook, you represent that you are not located in a country subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist-supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
12. Modifications to the Terms
We reserve the right to modify these Terms at any time. Changes will be communicated through an update in the App or on gigbook.app. Your continued use of the App after such changes constitutes your acceptance of the new Terms.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Colombia. Any dispute arising from these Terms shall be resolved before the competent courts of Colombia, without prejudice to available alternative dispute resolution mechanisms.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
15. Privacy Policy
Your use of Gigbook is subject to our Privacy Policy, available at gigbook.app/en/privacy, which is incorporated into these Terms by reference.
